LapPulse Terms of Use

Welcome to LapPulse. These Terms of Use ("Terms") govern your access to and use of the LapPulse mobile application ("App"), including all features, content, and services provided through it. By downloading, installing, or using LapPulse, you agree to be bound by these Terms. If you do not agree, do not use the App.

LapPulse is developed and operated by Artur Ploom ("Developer", "we", "us", "our"), an independent developer based in the European Union.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the App, you confirm that:

• You are at least 16 years of age (or the minimum age required in your jurisdiction).
• You have read, understood, and agree to be bound by these Terms.
• If you are using the App on behalf of a minor involved in motorsport, you accept these Terms on their behalf and assume responsibility for their use.

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. We will notify users of material changes through the App or via email where possible.

2. Description of the Service

LapPulse is a GPS-based lap timing and telemetry application designed primarily for kart racing. The App provides:

• Lap timing and telemetry recording using GPS data at up to 25 Hz (via compatible RaceBox Bluetooth Low Energy devices) or via the device's built-in GPS.
• Session recording with telemetry data including speed, g-forces, heading, and track position.
• Track creation and management for defining start/finish lines and track layouts.
• Track Workshop for browsing, publishing, and downloading community-created track layouts.
• Leaderboards for comparing lap times with other users.
• Social features including user profiles, a follow system, and content sharing.

3. Accounts and Registration

3.1 Optional Accounts

Core features of LapPulse (lap timing, session recording, track creation) work without an account. An account is required to access social features, leaderboards, and the Track Workshop.

3.2 Sign-In Methods

Accounts are created via Apple Sign-In or Google Sign-In. We do not store your password. Authentication is handled securely by Apple or Google.

3.3 Account Accuracy

You agree to provide accurate and up-to-date profile information. You must not impersonate other individuals or use misleading display names. You are responsible for all activity under your account.

3.4 Account Security

You are responsible for maintaining the security of the device and accounts used to sign in. Notify us immediately if you suspect unauthorized access.

4. Motorsport Safety

You agree to the following safety obligations:

• Never interact with the App while driving. All session setup, configuration, and review must be done while stationary and off-track.
• Secure your device. When using the App during a session, your phone or GPS device must be securely and safely mounted to prevent it from becoming a projectile or distraction.
• Authorized facilities only. Only use LapPulse at authorized motorsport facilities (kart tracks, race circuits, private tracks with permission). Never use LapPulse on public roads.
• Follow all track rules. Comply with all safety regulations, flag signals, and instructions from track officials at your venue.
• Wear proper safety equipment. Always use appropriate safety gear as required by your venue and racing class.
• Not a substitute for official timing. Do not rely on LapPulse for official race results, qualifying positions, or any competition-critical decisions.

You assume all risks associated with your participation in motorsport activities. LapPulse is a recording and analysis tool only. It does not replace driver judgment, proper training, track safety systems, or official timing equipment.

5. Track Workshop (Community Content)

5.1 Publishing Tracks

The Track Workshop allows authenticated users to publish track layouts for the community. When you publish a track:

• The track layout, name, description, location data, and your display name become publicly visible to all App users.
• You represent that you have the right to share this data and that the track information is accurate to the best of your knowledge.
• You retain ownership of the track data you create.

5.2 Content License

By publishing a track to the Workshop, you grant LapPulse a worldwide, non-exclusive, royalty-free, transferable license to host, display, distribute, and make available your track data within the App and related services. This license continues for as long as the content remains on the platform.

5.3 Content Standards

Published tracks must not contain:

• Offensive, obscene, or discriminatory language in names or descriptions.
• Deliberately inaccurate or misleading track data.
• Spam, advertising, or promotional content.
• Content that infringes on the intellectual property rights of others.

5.4 Content Moderation

We reserve the right to review, edit, or remove any published track at our sole discretion, including in response to user reports or violations of these Terms. We are not obligated to monitor all content but may do so.

5.5 Account Deletion and Published Content

If you delete your account, your published tracks will be anonymized (your display name removed) and retained on the platform to preserve the community track database that other users depend on. If you wish to have your tracks fully removed prior to account deletion, you may unpublish them individually before deleting your account.

6. Leaderboards

6.1 Automatic Submission

When you are signed in, your best lap times are automatically submitted to track leaderboards. Only times recorded using real GPS data (device GPS or compatible hardware) are eligible.

6.2 Fair Play

You agree not to:

• Submit fabricated, simulated, or manipulated GPS data to leaderboards.
• Use mock or spoofed location data to achieve leaderboard positions.
• Exploit bugs or technical vulnerabilities to manipulate rankings.
• Collude with other users to distort leaderboard results.

Mock and simulated GPS data is detected and rejected server-side. We reserve the right to remove any leaderboard entries that appear suspicious, without prior notice, and to suspend or terminate the accounts of users who violate fair play rules.

7. Social Features and User Conduct

7.1 Profiles and Following

Authenticated users may set their profile to public or private and follow other users. Public profiles are visible to all authenticated users. Private profiles limit visibility of certain information.

7.2 Acceptable Conduct

You agree not to:

• Harass, bully, threaten, or abuse other users.
• Use offensive, discriminatory, or hateful language in any user-facing content.
• Create multiple accounts to circumvent bans or restrictions.
• Use the App to collect personal data about other users beyond what is publicly displayed.
• Engage in any conduct that disrupts or degrades the experience for other users.

7.3 Reporting

Users may report content or behavior that violates these Terms. We will review reports and take appropriate action, which may include content removal, warnings, or account suspension. Abuse of the reporting system is itself a violation of these Terms.

8. Intellectual Property

8.1 App Ownership

The LapPulse application, including its code, design, graphics, user interface, logos, and branding, is the proprietary property of Artur Ploom. All rights not expressly granted in these Terms are reserved.

8.2 Your Data

You retain ownership of the data you generate through the App, including session recordings, telemetry data, and track layouts you create for personal use. We do not claim ownership of your personal data.

8.3 Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the App.
• Copy, modify, or create derivative works based on the App.
• Remove or alter any proprietary notices or labels.
• Use the App's name, logo, or branding without written permission.
• Access the App's backend systems or APIs except through the normal operation of the App.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through the App settings. Upon deletion:

• Your account and profile will be permanently removed.
• Your leaderboard entries will be removed.
• Published Track Workshop content will be anonymized as described in Section 5.5.
• Local data on your device will not be affected by account deletion.

9.2 Termination by Us

We may suspend or terminate your account, without prior notice, if:

• You violate these Terms or any applicable law.
• Your account is involved in leaderboard manipulation or fair play violations.
• You engage in harassment or abusive behavior.
• We reasonably believe continued access poses a risk to other users or the platform.

Where possible, we will provide notice and an explanation of the reason for termination.

10. Disclaimers and Limitation of Liability

10.1 "As Is" Provision

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10.2 No Accuracy Warranty

We do not warrant the accuracy, reliability, or completeness of any GPS data, lap times, telemetry readings, or other measurements provided by the App. GPS accuracy depends on factors beyond our control, including satellite availability, atmospheric conditions, device hardware, and signal obstructions.

10.3 Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any personal injury, death, property damage, or accident arising from or related to your use of the App or participation in motorsport activities.
• We are not liable for any loss of data, sessions, or recordings, whether caused by device failure, App bugs, or other circumstances.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total aggregate liability for any claim arising from your use of the App shall not exceed the total amount you have paid to us for the App in the twelve (12) months preceding the claim. If the App was provided free of charge, our maximum liability is ten euros (EUR 10).

10.4 Third-Party Hardware

LapPulse is compatible with third-party GPS hardware (such as RaceBox devices). We are not responsible for the performance, accuracy, or safety of any third-party hardware. Third-party devices are subject to their own terms and warranties.

11. Indemnification

You agree to indemnify and hold harmless Artur Ploom from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your participation in motorsport activities while using the App.
• Content you publish through the Track Workshop.
• Your violation of any rights of a third party.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the App, you consent to the practices described in the Privacy Policy.

13. Changes to the App

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App or any feature within it.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the Republic of Estonia, without regard to conflict of law principles.

We encourage you to contact us first to resolve any disputes informally. If a dispute cannot be resolved informally, it shall be submitted to the competent courts in Estonia, except where EU consumer protection law grants you the right to bring proceedings in your country of residence.

EU consumers may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Artur Ploom regarding your use of LapPulse. They supersede any prior agreements or understandings.
